These Terms constitute a legally binding agreement between you and SlouchGoblin. These Terms apply to your use of the SlouchGoblin macOS application ("the App") and the SlouchGoblin website (collectively, "the Service"). We reserve the right to update these Terms at any time. Material changes will be communicated via email or in-app notice. Your continued use after such notice constitutes acceptance.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on devices you own or control, solely for your personal or internal business use.

This licence does not include the right to:

• Distribute, sublicense, sell, or transfer the App to third parties
• Reverse-engineer, decompile, or disassemble the App
• Modify or create derivative works based on the App
• Remove or alter any proprietary notices within the App

You may use SlouchGoblin for lawful purposes, including:

• Personal posture and eye strain monitoring
• Use in a professional workplace environment
• Team wellness monitoring (Team plan)

You agree not to use the Service to:

• Violate any applicable law or regulation
• Monitor individuals without their knowledge or consent
• Attempt to gain unauthorised access to any system or network
• Interfere with or disrupt the integrity or performance of the Service
• Circumvent licensing, subscription, or device limits
• Use the Service in any way that could harm, disable, or impair it

SlouchGoblin offers a 2-week free trial with no credit card required. After the trial, you may choose from a Monthly ($8.99/month), Yearly ($64.99/year), or Lifetime ($98.99 one-time) plan.

Monthly and Yearly subscriptions automatically renew unless cancelled before the renewal date. Lifetime Access is a single one-time charge with no recurring fees and includes all future updates.

You may cancel a subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; no partial-period refunds are issued except where required by applicable law or our money-back guarantee.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Key points: camera data is processed locally and never stored or transmitted; most data never leaves your device.

SlouchGoblin and all related content, features, and functionality — including but not limited to text, graphics, logos, icons, and software — are owned by SlouchGoblin and protected by applicable intellectual property laws.

Feedback, suggestions, or ideas you provide to us may be used by us without restriction or compensation.

SlouchGoblin is a wellness tool, not a medical device. It is not intended to diagnose, treat, cure, or prevent any health condition. Information and alerts provided by the App are for informational purposes only. Consult a qualified healthcare professional for medical advice regarding posture, ergonomics, or eye health.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any posture scores, blink rate data, or other output.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SLOUCHGOBLIN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless SlouchGoblin and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or misuse of the Service.

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may stop using the Service at any time.

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in San Francisco County, California.
